1. Acceptance of Terms
- By accessing or using LocalMomAndPopShops.com (“LMPS,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our service.
2. Description of Service
- LMPS is an online directory platform that connects local businesses with community members in Nassau County, New York. We provide listing services, business information display, and community connection tools.
3. User Accounts and Registration
3.1 Account Creation
- You must provide accurate, current, and complete information
- You are responsible for maintaining account security
- You must be 18 years or older to create an account
- Business listings must represent legitimate, operating businesses
3.2 Account Responsibilities
- Maintain confidentiality of login credentials
- Notify us immediately of unauthorized account access
- Update information to keep it current and accurate
4. Subscription Services and Billing
4.1 Subscription Plans
- Standard Plan: $60/month
- Premium Plan: $120/month
- Ultra Premium Plan: $250/month
- Founding Member rates: 50% discount for qualifying members
4.2 Billing Terms
- Subscriptions automatically renew monthly unless cancelled
- Payment is due in advance of each billing period
- All fees are non-refundable except as required by law
- We reserve the right to change pricing with 30 days notice
4.3 Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of current billing period
- No refunds for partial periods unless required by law
5. Business Listings
5.1 Listing Content
- Business information must be accurate and current
- You own the content you submit
- You grant us license to display and promote your content
- We reserve the right to edit listings for formatting and compliance
- You’re responsible for the accuracy and legality of content you submit. LMPS may edit for clarity/format and may refuse or remove listings that violate policy or law. Local-only policy applies: independent local micro/small businesses; no national chains.
- Clarification: LMPS provides only an advertising platform. No partnership, joint venture, employment, or agency relationship is created between LMPS and any business listed. The sole relationship is the publication of an advertisement (“the listing”). Businesses remain solely responsible for all content they submit or approve for publication, including any edits or assistance LMPS provides. By approving such content for publishing, businesses release and hold harmless LMPS from any claims arising from that content.
- You represent and warrant that you have all rights, licenses, and permissions necessary to submit content, including intellectual property rights in text, logos, and images. If content includes photographs or depictions of people, you warrant that you have obtained valid signed releases and permissions, especially for minors, to authorize publication.
5.2 Prohibited Content
- False, misleading, or fraudulent information
- Inappropriate, offensive, or illegal content
- Spam or irrelevant promotional material
- Content that violates third-party rights
5.3 Geographic Restrictions
- Listings are limited to businesses serving Nassau County, NY area
- Service area restrictions may apply based on business type
6. Intellectual Property
6.1 Our Rights
- LMPS platform, design, and functionality are our property
- Our trademarks, logos, and branding are protected
- Users may not copy, reproduce, or create derivative works
6.2 User Content
- You retain ownership of your business information
- You grant us license to use, display, and promote your content
- You represent that you have rights to all submitted content
7. Platform Usage Rules
7.1 Acceptable Use
- Use platform only for legitimate business purposes
- Respect other users and community guidelines
- Do not attempt to circumvent platform features or security
7.2 Prohibited Activities
- Scraping, harvesting, or mining platform data
- Interfering with platform operation or security
- Creating fake accounts or listings
- Harassing other users or businesses
8. Privacy and Data Protection
- Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information.
9. Disclaimers and Limitations
9.1 Service Availability
- Platform is provided “as is” without warranties
- We do not guarantee uninterrupted service availability
- Features and functionality may change without notice
9.2 Business Information
- We do not verify accuracy of business information
- Users rely on business information at their own risk
- We are not responsible for business-customer interactions
9.3 Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, LMPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Indemnification
- You agree to indemnify and hold harmless LMPS from any claims, damages, or expenses arising from your use of the platform or violation of these terms.
11. Termination

- Cancel subscription through account settings
- Download your data before cancellation if desired
11.2 Termination by Us
- We may suspend or terminate accounts for terms violations
- We may discontinue service with reasonable notice
- Outstanding fees remain due upon termination
12. Changes to Terms
- LMPS may update these Terms from time to time. Each version will carry a version identifier in the form of a date (e.g., “LMPS Terms v20250929”). It is the responsibility of business advertisers to remain aware of the current version posted at the Terms link. Continued use after the effective date constitutes acceptance of the new version.
13. Governing Law
- These terms are governed by the laws of New York State without regard to conflict of law principles. Any disputes shall be resolved in Nassau County, New York courts.
